This Privacy Policy (“Privacy Policy”) sets out how SaySimons, LLC (referred to as “us”, “we”, “our”, or “SaySimons”) uses and protects any information that you (referred to as “Customer”, “you”, or “your”) provide when accessing, browsing, making a purchase on, registering, and/or using our website, https://www.saysimons.com/ (the “Website”) or download the SaySimons Mobile Application (the “App”, together with the Platform referred to as the “Platform”) on the Apple App Store or Google Play, where available (together the “App Store”).
SaySimons is committed to ensuring that your privacy is protected. You can be assured that any personal identifying information (“Personal Information” as defined below) you provide when using this Platform will only be used in accordance with this Privacy Policy. This Privacy Policy describes the type of information SaySimons may collect from you or that you may provide when using the Platform, as well as SaySimons’ practices for collecting, using, keeping, protecting, and/or disclosing any Personal Information. By accessing or using the Service, you acknowledge that you have read this Privacy Policy.
I. COLLECTION AND USE OF PERSONAL INFORMATION
Personal Information We Collect
When browsing, entering, engaging with, or otherwise accessing our Platform; contacting SaySimons; purchasing the Services; or conducting any other activity on the Platform as described in the Terms and Conditions (the “Terms”), you may be asked to enter or disclose various types of Personal Information, which may include, but is not limited to:
- Contact Information and Account Registration: name, email, postal address, telephone number, date of birth, business contact information, or any other similar information you may provide.
- Identification and Demographics: date of birth, gender identity, nationality, ethnicity, interests, lifestyle information, dating preferences, personal stories, photos, social media credentials, contacts or referrals you provide.
- Transactional: subscription tier and Apple/RevenueCat identifiers.
- Customer Content: photos, videos, and other information you may provide, such as profile photos and photos sent in chat
- Profile Content: Bio, prompt answers, interests, relationship goals, and lifestyle facts such as, smoking, drinking, drug-use relationship, having/wanting children, diet, religion, education, job.
- Communication: Message text and chat images; read receipts; the record of who liked, passed on, or matched with whom; date plans (free text plus the time/place two users arrange to meet)
- Research and Feedback: reviews and comments that you send through the Platform and social media platforms; by email, over the phone or by mail.
- Device Information and Identifiers: IP addresses, cookie IDs, browser types and language, operating systems, platform type, and device type, Push-notification tokens; hashed device fingerprints used for safety / ban-evasion
- Connection and Usage: usage of the Service, pages viewed, features used, search terms, session activity, crash reports, diagnostic information, and other technical usage data.
- Geolocation: Approximate location, including city and county. With your permission, we may temporarily collect your device's precise GPS location to support optional features, such as verified presence or travel. Precise location data is used only to determine your approximate location and is not retained. Only a coarsened approximate location and county are stored and are deleted on a rolling basis and upon account deletion.
- Social Media Information: SaySimons does not currently offer social media login, friend-list access, contact import, or social media plug-ins. If SaySimons later offers features that allow you to connect your account to a third-party platform or social media service, we may collect information from that service only as disclosed at the time of connection and based on your settings and permissions with that service.
- Additional Information: any additional information you provide us either directly through the Platform or through your participation, support request, interaction through SaySimons’ social media accounts, or any other communication.
How We Collect Personal Information
Generally, you are not under any statutory or contractual obligation to provide any Personal Information; however, certain Personal Information may be automatically collected in order to make a purchase on the Platform. We collect and process your Personal Information where necessary to provide the Service, where you have provided consent, where required by law, or where we have another lawful basis for processing.
SaySimons collects information from you when you browse, enter, or use this Platform; contact us; download a program; purchase our Services; fill out an online form; or otherwise enter any information on our Platform or social media platforms which may include Facebook, Instagram, Twitter, YouTube, Pinterest, TikTok, Google, or other third party applications (together the “Third Party Platforms”).
How We Use Personal Information
SaySimons may use such Personal Information in any of the following ways:
- To personalize your experience on the Platform.
- To maintain and improve the Platform in order to better serve you and provide a more seamless experience across all devices.
- To allow us to better service you in responding to service requests or other queries.
- To administer a contest, promotion, survey or other feature.
- To quickly process your transactions.
- To send periodic e-mails with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us. - To investigate and help prevent security issues, abuse, or violations of law or the Terms.
- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our Service users is among the assets transferred.
- Displaying content you generate, such as video, audio and comments on the Platform or on third Party Platforms.
- Compliance with laws, regulations, and ethical business conduct.
- We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
AI-Powered Features
The Service may offer optional AI-powered features, such as coaching or other personalized assistance. If you choose to use these features, the information you submit may be processed by our third-party AI service provider solely to provide the requested functionality, improve the quality of the feature, maintain security, and prevent misuse. Use of AI-powered features is entirely optional and is not required to use the core functionality of the Service.
Legal Bases for Processing Personal Information
Where required by applicable law, we process your Personal Information only where we have a valid legal basis to do so. Depending on the circumstances, these legal bases may include:
- Performance of a Contract: To provide and maintain the Service, create and manage your account, process transactions, and fulfill our obligations to you.

The Service is designed to allow you to create a profile and share information with other users. Any information, photographs, videos, messages, or other content that you choose to include in your profile or otherwise make available through the Service ("User Content") may be visible to other users in accordance with your privacy settings.

SaySimons takes the security of your Personal Information very seriously. We implement a variety of security measures when you use the Platform; or otherwise enter or input your Personal Information. Your customer account is protected by password for your privacy and security. If you access your customer account via a third party, you may have additional or different sign-on protections. You must prevent unauthorized access to your Customer Account and Personal Information by selecting and protecting your password and/or other sign-on mechanisms appropriately. Your Personal Information is accessible only to a limited number of persons who have the authority to access it, including but not limited to, contractors or agents we may employ to perform tasks, fix bugs, and/or monitor the Platform on our behalf. Please note that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially reasonable means to protect your Personal Data, we cannot guarantee its absolute security.
Children’s Privacy
SaySimons does not want to, and does not knowingly, collect any data from individuals under the age of 18. If we learn that we have collected any such data without the supervision of a parent or legal guardian, we will take all reasonable measures to delete such information and will not use it for any purposes. If you become aware of any Personal Information that we have collected from a child under the age of 18 without the supervision of a parent or legal guardian, please contact us immediately.
Cookies and Similar Technologies
We and our service providers use cookies and similar technologies (such as cookies, local storage, web beacons, and embedded scripts) to operate, secure, and improve the Service, remember your preferences, and understand how the Service is used.
Cookies may be Session Cookies, which are deleted when you close your browser, or Persistent Cookies, which remain on your device until they expire or are deleted.
Where required by applicable law, we use non-essential cookies only with your consent. You may withdraw or modify your consent at any time through our cookie preference center (where available) or your browser settings. Disabling certain cookies may affect the functionality of the Service.

We do not use cookies or similar technologies for cross-site behavioral advertising or cross-app tracking.
Tracking and Advertising Practices
We do not use advertising software development kits (SDKs), advertising identifiers, cross-app tracking technologies, or technologies that track your activity across third-party websites or applications for advertising purposes. We do not engage in cross-context behavioral advertising.
Any pseudonymous identifiers shared with our service providers are used solely to operate, maintain, secure, and improve the Service, including subscription management, payment processing, analytics, error monitoring, and fraud prevention. They are not used for advertising or marketing purposes.
Accessing, Updating, and Deleting Your Personal Information
You may access, update, or delete your Personal Information at any time through your account settings or by contacting us.
You may also request that we delete the Personal Data we have collected about you. We will honor such requests where required by applicable law, subject to any legal or legitimate business reasons for retaining certain information, such as compliance with legal obligations, dispute resolution, fraud prevention, or enforcement of our agreements.
Please note that we may retain information related to individual sales transactions or purchases in order to complete said transactions and for record keeping purposes.
Retention of Personal Information
We retain your Personal Information only for as long as necessary to provide the Service, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce our agreements.
Retention periods vary depending on the type of information and the reason it was collected. In general:
- Account information: Retained while your account is active and for up to 24 months after account closure. If you delete your account, your profile will no longer be visible to other users. Certain information may be retained for legal compliance, fraud prevention, dispute resolution, enforcement of our Terms, and to maintain limited pseudonymized moderation and audit records. For users whose accounts have been suspended or banned for violations of our Terms, we may also retain hashed identifiers for up to two (2) years to help detect and prevent ban evasion.
- Customer support records: Support communications and chat transcripts may be retained for up to 24 months after the matter is resolved.
- Usage data: Analytics, server logs, IP addresses, and similar technical information may be retained for up to 24 months, or longer where necessary for security, fraud prevention, or legal compliance.
- Marketing information: Retained until you unsubscribe or for up to 24 months after your last engagement, whichever occurs first.
We may retain Personal Information for longer where required by law, to establish, exercise, or defend legal claims, to comply with your request, or where data remains in secure backup systems pending routine deletion.
When Personal Information is no longer needed, we securely delete or anonymize it. Anonymized data that cannot reasonably identify you may be retained for research, analytics, and business purposes.
How We Share Personal Information
We may share your Personal Information in the following circumstances:
- With Service Providers: We may share your Personal Information with third-party service providers that help us operate, maintain, and improve the Service. These providers perform services such as cloud hosting, authentication, subscription management, payment processing, email delivery, security and fraud prevention, application monitoring, analytics, and identity verification. They receive only the Personal Information necessary to perform their services on our behalf and are contractually required to protect and process such information in accordance with applicable law and our instructions. Our service providers may include, among others, Supabase, Apple, RevenueCat, OpenAI (for optional AI-powered features), Amazon Web Services (AWS), Sentry, Resend, hCaptcha, and Stripe.
- With Business Partners: We may share your Personal Information with trusted business partners to provide products, services, promotions, or other offerings that may be of interest to you.
- Business Transfers: If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, your Personal Information may be transferred as part of that transaction.
- Legal Compliance: We may disclose your Personal Information where we believe it is necessary to comply with applicable law, legal process, court orders, governmental requests, or other legal obligations.
- Protection of Rights and Safety: We may disclose your Personal Information where necessary to protect the rights, property, or safety of SaySimons, our users, or others, including to enforce our Terms, investigate fraud, prevent security incidents, or respond to claims.
- Public Areas and Other Users: If you create a public profile, post content, or otherwise interact with public features of the Service, the information you choose to share may be visible to other users and may be publicly available.
- At Your Direction or With Your Consent: We may share your Personal Information with third parties when you request or authorize us to do so, or otherwise provide your consent.
We may also share aggregated or de-identified information that cannot reasonably be used to identify you for research, analytics, marketing, or other lawful business purposes.
Third Party Platforms and Services
Occasionally, at SaySimons’s discretion, we may include or offer third party advertisements or Services on the Platform. These third parties have separate and independent privacy policies. Therefore, we have no responsibility or liability for the content and activities of these third parties. Nonetheless, we seek to protect the integrity of the Platform and welcome any feedback about these other third party links.
II. INTERNATIONAL DATA TRANSFERS
SaySimons is headquartered in the United States; however, it may transfer your information to service providers and other third parties located outside of your country of residence, including in the United States. This may be necessary to provide our Services and for the purposes outlined in this Privacy Policy. Data privacy laws vary from country to country and may not be equivalent to, or as protective as, the laws in your home country. SaySimons takes steps to ensure that reasonable safeguards are in place with aim to ensure an appropriate level of protection for your Personal Information, in accordance with applicable law. Where required by law, we implement appropriate safeguards, including contractual safeguards and other legally recognized transfer mechanisms. By providing SaySimons with your Personal Information, you acknowledge any such transfer, storage or use.
Some Services can only be provided if we have your Personal Information, therefore deletion of your Personal Information may result in termination of such Services. SaySimons will take reasonable steps to verify your identity, including authenticating you through your email address. We may require further documentation such as a password and email address/customer ID before granting access to your information.

California "Shine the Light" Rights
